Regulations on conversion of Land Tenure Rights in place
09 Apr 2024
Regulations relating to the Conversion of Land Tenure Rights are in place.
The agriculture, land reform and rural development department published the regulations in Government Gazette 50425 in terms of the Upgrading of Land Tenure Rights Act of 1991.
The regulations were published for comment in Gazette 49787 at the end of November 2023 with comment extended at the beginning of March 2024.
They flow from the Upgrading of Land Tenure Rights Amendment Act signed by president Ramaphosa in 2021.
The act comes into effect on a date still to be determined by the president.
The regulations focus on application for conversion of land tenure right; notice of application; objection to conversion of land tenure right; and informing the registrar of the decision.
The regulations call for the agriculture, land reform and rural development minister to, after making a decision relating to the conversion of a land tenure right and the vesting of ownership as contemplated in section 2(1D) of the act, inform the registrar of such decision.
The regulations came into effect on 1 April 2024.
