Thabo Mohale has experience in labour law, and holds an LLB (University of Witwatersrand) and LLM (Business Law) (University of Kwa Zulu Natal).
Thabo is responsible for the Labour Law department. He specialises in employment law and advises on a wide range of issues including small and large scale restructurings and retrenchments, transfers of business as a going concern, employment and employee benefit consequences of commercial transactions, restraint of trade litigation, dispute resolution, disciplinary investigations, initiating and chairing hearings, dismissals for incapacity, employment discrimination, employment equity and occupational health and safety.
Thabo’s expertise extends to drafting and reviewing company policies and procedures, employment contracts, including fixed-term employment and independent contractors, collective bargaining, including interdicting strikers, and training. Thabo has a particular interest in adjudicating disciplinary and grievance hearings and has to date, chaired over 300 hearings. He has drafted opinions on many aspects of labour law.
Thabo works closely with his corporate and commercial litigation colleagues. He has extensive litigation experience from the CCMA level up to the Labour Court and the High Court. Thabo has been involved in litigation in South Africa, Namibia and Botswana. Thabo’s clients include a number of national and multinational companies stretching across various industries, including retail, consumer goods, property, engineering, mining and consulting.
In addition, Thabo has advised clients on issues relating to the protection of intellectual property, particularly on trade mark selection, searching, registration and enforcement. He has advised clients in relation to copyright disputes and has experience relating to anti-counterfeiting operations.
Thabo is experienced in general commercial law and is adept at drafting various commercial documentation including shareholders agreements, memoranda of incorporation and sale agreements.
Thabo is an avid researcher and writer and has published in various publications.
