Regulations on community mental health care facilities drawn up

Comment is sought on Draft Regulations for licensing community mental health day care and residential care facilities for people with mental illness.

The health department published the Draft Regulations in Government Gazette 46589 in terms of the Mental Health Care Act.

The proposed Regulations apply to day care and residential care facilities that provide care, treatment and rehabilitation to five or more people with mental illness and/or severe or profound intellectual disability.

They are designed to regulate the licensing of day care and residential care facilities for people with mental illness and/or severe or profound intellectual disability.

The Draft Regulations focus on, inter alia, eligibility to operate a day care or residential care facility; prohibition; application procedure; handling of applications; granting or refusal of licences; cancellation of licences; appeal procedure; renewal of licences; termination of operations; compliance, monitoring and reporting; rights of mental health care users; user health records; policies; clinical care and treatment and psychosocial rehabilitation.

Comment is invited within three months of the date of publication.
